Tradermania is an online trade website for private and business sellers to advertise and sell their products. When you use the Tradermania website or login, you agree to the terms and conditions in this document. Tradermania may change the terms and conditions at any time, without giving you prior notice and it is your responsibility to visit our terms and conditions on a regular basis to make sure you are familiar with changes to this user agreement.

1. The Tradermania website is a venue for buyers and sellers to buy, sell, advertise and trade approved items or services by means of auctions, classifieds, offers, quotes or fixed price sales. Tradermania is not an auctioneer as under the Auctioneers Act and provides the venue only.

2. You agree not to trade, list or display forbidden items. Forbidden items are drugs, illegal weapons, pornography, alcohol, stolen items and copyright material.

3. You agree that you will not list sexual explicit or offensive material of any nature and will list adult material in the Adult R18 category. The Adult R18 category is protected by user login.

4. Tradermania does not directly take part in the auction or selling process. Tradermania does not act as an agent for any party and transactions are strictly between buyers and sellers. The Tradermania website is an automated software program managing bids and timelines of listings and informs traders of activity and the progress of sales and related information. Buyers and sellers manage their own transactions from start to finish.

5. When you register you agree to provide your name, surname, full address details and home phone number, and make sure you are contactable by us. When you change address you will use your personal "Account" control panel to update your information. You agree to use the Tradermania address verified system to verify your address details.

6. Tradermania members accept responsibility for their own login and password information. You agree to keep your login and password information in a safe place and not to disclose this information to anybody else.

7. Tradermania does not allow the use of multiple user names for the same user. You are only allowed one username and password. You are not allowed to use the name of a company or trademark as a username unless you are the legal owner of the company name or trademark. Accounts and username cannot be sold.

8. The price items sell for include sales tax or as otherwise listed by the seller. Tax obligations are the responsibility of the seller or buyer or as negotiated by the involved parties.

9. Promotional incentives paid to your personal Tradermania account by Tradermania, for example bonus credits or registration bonuses will not be refunded for cash.

10. Tradermania is a pre-paid web site and it is your responsibility to always pay your success fees on time. Success fees are payable immediately after the sale.

11. Tradermania use e-mail, mobile sms text messages as medium to communicate with all members. Some e-mail’s are informational and some are part of the auction/selling process generated by the system. By registering you accept to be part of our e-mail list and accept to be e-mailed by interested buyers inquiring information about your auctions or classifieds. You also agree to reply promptly to questions and communications from other members.

12. You agree not to use offensive language when communicating with other traders via e-mail, video or live chat.

13. Tradermania reserves the right to, without prior warning, revoke any user membership at any time.

14. Tradermania reserves the right to remove any listing, without prior warning for any reason we feel fit.

15. To qualify for a Tradermania online web store, you, your business or company must comply with the consumer guarantees act, have a designed graphical business logo and have a reputable trading history. Store logos are reviewed and approved by Tradermania. 

16. You may request a refund for success fees and listing fees when your item was sold, we charged you a success fee and the buyer defaulted. Tradermania does not refund membership subscriptions.

17. You agree that when you use the Video listing feature to comply with the terms of the appropriate video website you use to list videos of items that you sell on Tradermania. Tradermania does not claim ownership of the content you place or otherwise make available through the video service. By submitting content for inclusion on the Service, you grant Tradermania a world-wide, perpetual, royalty-free, and non-exclusive license to use, reproduce, modify, adapt, publicly perform, publicly display and publish the content solely for the purpose of providing and promoting the Service in any and all media. This license exists for as long as you elect to continue to include such content on the Service and will terminate at the time you remove or Tradermania removes the content from the Service. Except for member-contributed content, all aspects of the Service of the Tradermania website, including but not limited to the graphics, text, audio, images, pictures, icons, movies, video, layout, and look and feel of the site is protected by copyrights, trademarks and service marks. Content from the Service may be downloaded and/or reprinted for personal use only. Except as expressly authorized by Tradermania Limited, you agree not to modify, rent, distribute, lease, loan, sell, or exploit for any commercial purpose any portion of the Service, use of the Service, or access to the Service, and not to create derivative works based on the Service, in whole or in part.

18. Tradermania has intellectual property rights in content, operation and our software. These rights include all copyright, trademark and design rights. Your use of any programs and software provided by us is governed by the terms of this user agreement. Tradermania grants to you a revocable personal, non-transferable license to use software for viewing, if not accompanied by a license agreement. Any reproduction or redistribution of the content and/or software is prohibited.

19. You agree to indemnify Tradermania against any actions, claims and demands (including the cost of defending or settling any action, claim or demand) which may be instituted against Tradermania and arising from a failure by us to comply with these terms and conditions or a failure by the other party relating to a transaction to comply with these terms and conditions or to complete a transaction.

20. While every endeavour has been made to ensure our software works correctly, errors may occur. Accordingly, Tradermania does not accept any liability for any loss or damage which may directly or indirectly result from any errors or network delays resulting from poor telecommunication networks or software errors beyond our control.

21. When you register to trade online at Tradermania you declare by registering that you are 18 years or older. This means that when you buy or sell, that you are of a legal age and able to enter into a legally binding contract and complete transactions you enter into.

22. Tradermania is not liable to any registered user for any loss or damage incurred by the user for any transactions concluded while trading on the Tradermania website. Use an escrow service for payments. Escrow services help to protect buyers and sellers from fraudulant transactions.

23. Tradermania does not warrant that any service provided would be uninterrupted, timely, and secure or error free including information or feedback by any users.

Sellers

1. You agree to list items and products that legally belong to you.

2. You agree that items and products that you list are in your possession and available to the buyer immediately after payment. If you do not have the item(s) in your possession, you agree to state this together with enough information regarding the delivery details in your listing.

3. You agree to state in your auction of your intention to withdraw or end your auction or sale early.

4. You agree to use dutch auctions if you have a quantity of more than one of the same item and you will not make more than 5 listings of the item if you are using single item auctions or fixed price sales. 

5. You agree to list your item in the appropriate category provided. You accept that when you list an item in the wrong category where success fees apply rather than listing fees, you will pay success fees rather than listing fees.

6. You accept to sell and deliver your item or product to the highest bidder. If the reserve price of your item is met, then this will be the price you sold it for, excluding shipping costs or as stated by you in your auction listing.

7. You accept to sell and deliver your item if sold via ‘fixed price’ sale or ‘buy it now’ for the price listed, excluding shipping costs or as stated in your listing.

8. You agree to give a detailed and accurate description of your item or product you are selling. You agree not to make misleading or false descriptions and information in the description of items.

9. You will not attempt to manipulate the bidding on an auction by any way or means.

10. You will not offer items to another bidder unless contact with the winning bidder cannot be made within a reasonable time, or the winning bidder fails to comply with the terms of sale stated in the item description of your listing.

11. You may not include your phone number, email address, residential address, phone number, website URL address or other method of contact in auctions, fixed price sales or trade listings.

12. You may list your phone contact in your auctions selling vehicles to arrange for viewing only. This applies to vehicle and property listings only.

13. You may list your contact details and web address details in classified listings.

14. You may not advertise, sell or place leading advertising of or to other auction websites in Tradermania listings.

15. You agree when selling or advertising any Weight Management/Weight Loss products to conform to the rules and regulations of the Ministry of Health. It is your responsibility to make sure you fully understand the regulations and liabilities before selling or advertising such products on Tradermania. 

16. You agree when selling or advertising any Over-the-Counter (OTC) medicines direct to the consumer to conform to the rules and regulations of the Ministry of Health. It is your responsibility to make sure you fully understand the regulations and liabilities before selling or advertising such products on Tradermania.
 

Bidders/Buyers

1. When you buy an item or product, you accept that you have entered into a legal binding contract with the seller. You accept to complete the transaction and make payment as per the listing details and as agreed with the seller.

2. It is your responsibility to ask questions and make sure the seller is trustworthy. Ask the seller’s contact details i.e. home phone number and address details. Check the seller before you buy expensive items. Check the feedback of sellers. When you are not sure, use the escrow payment system. The system is there to protect buyers and sellers from any fraudulant transactions.

3. You accept that the bids you make are your offer to buy the item at the bid price you entered. Once you made your bid you cannot change it.

4. You will not make false bids and intentionally increase the price of items on auction.

5. If you bought an item and find out without reasonable doubt that the item could be stolen or you get suspicious of any fraudulent activity with proof, contact us and tell us about it. This will be the only acceptable reason for in-complete transactions.
